GENERAL RULES
1. By agreeing to the terms of use, you accept and warrant that you fully understand and agree to comply with all of the following terms and conditions (including all guidelines or rules applicable to our service posted on our website which guidelines and rules are hereby incorporated into this Agreement), and that failure to abide by these terms and conditions may result in disqualification, account closure, forfeiture of funds and/or legal action against you. If you have any questions as to these Terms and Conditions, we encourage you to seek independent counsel prior accepting the Agreement.
2. circlebet is operated by Entraction Operation Ltd (former 24hPAY Ltd), Malta. Gaming modules are provided by Entraction Network Ltd (former B2B Poker Network Ltd), Malta (Poker), Net Entertainment Malta Ltd, Malta (Casino) and Boss Malta Ltd, Malta (Cardroom2).
3. The operations of Entraction Operation Ltd (former 24hPAY Ltd) are regulated and licensed by the Lotteries and Gaming Authority of Malta (the LGA), http://www.lga.org.mt/. Entraction Operation Ltd (former24hPAY Ltd) holds a Class 2 license (No. LGA/CL2/236/2005), a Class 1 on 4 license (No. LGA/CL1/236/2005) and a Class 3 on 4 license (No. LGA/CL3/236/2005) and Class 3 on 4 (Cardroom II license (No. LGA/CL3/236/2007). Entraction Network Ltd (former B2B Poker Network Ltd) holds a Class 4 license (No. LGA/CL4/233/2005), Net Entertainment Malta Ltd holds a class 4 license (No. LGA/CL4/184/2004) and Boss Malta Ltd holds a Class 4 license (No. LGA/CL4/206/2005).
4. As the text in this Agreement as well as the rules and guidelines at our website are presented in several languages. English is always the deciding language in case of differences in interpretation.
5. The management reserves the right to make changes in the rules at any time. All clients agree to be bound by all current rules and are advised to read them on a frequent basis.
6. All clients must be at least 18 years of age, or the legal age of majority in their jurisdiction, whichever is greater. For Estonian citizen the requirements are at least 21 years of age.
7. Residents of Costa Rica, Cuba, Hong Kong, India, Iran, Iraq, Macau, Malta, Nigeria, South Korea, Turkey and USA are not allowed to open an account or in any way use the gaming services offered by circlebet .
8. circlebet reserves the right to refuse any application without further explanation.
9. circlebet also reserves the right to close down existing accounts without explanation. In this event, or in the event of an account closure by a client, the full balance will be paid out unless any fraudulent behavior is suspected.
10. Each person is only allowed to have one account with circlebet .
11. It is up to each client to make sure that no local laws or regulations are violated. circlebet takes no responsibility whatsoever for clients not abiding such rules.
12. All clients are obliged to provide their full and accurate personal details. Failure to provide full and accurate personal details may result in disqualification, account closure or forfeiture of funds.
13. It is your responsibility to protect your Player ID and Password. Any actions carried out by the use of your login details are at your sole risk and any liability there from shall be strictly yours. It is very important that there is antivirus software installed on the computer in use. The antivirus application must be updated with new virus definitions on a regular, preferably daily basis.
14. The player account is individual and the client is entirely responsible for account obligations and also entitled to all profits and benefits.
15. If disputes arises between clients or between clients and circlebet the judgment of the circlebet management is final, binding and conclusive in all matters.
16. circlebet is not responsible for any claims, losses or damages under any condition. All participating in our games are made at your own risk.
17. Clients shall not hold the gaming operator, its owners, employees, affiliates or other companies or people linked to circlebet responsible for any costs or damages caused by;
1. the use of the website,
2. the use of any material from the website,
3. the use of any of our servers,
4. the use of any of our software,
5. participation in any game or
6. the winning of any prize.
18. All taxes, duties and fees applicable in connection with any winnings at circlebet are the sole responsibility of the client.
19. circlebet takes active measures necessary to prevent, and to investigate suspected cases of, all kinds of fraud, collusion, money laundering activities and/or other forms of criminal activity. Any such case may be reported to the relevant authorities.
20. Any changes in the player’s personal information should be updated in the player account as soon as possible.
21. circlebet reserves the right to ask for documents at any time in order to prove the identity of the client. The client will have to provide identification whenever the client makes withdrawals of funds amounting to €2000 or more. 22. circlebet does not report client’s winnings to any government agencies. It is solely the client's responsibility to report any income from gaming activities to his/her government agencies, if required.
23. circlebet guarantees to handle all player accounts with strict confidentiality. This confidentiality can only be breached by order of the Maltese authorities or when criminal activities are suspected or reported to circlebet or to financial institutions or auditors related to circlebet .
24. circlebet reserves the right to cancel your player account for any justifiable reason whatsoever at any time without notice to you. If you do not access your circlebet account by "logging in" to your account for a period of twelve (12) months, circlebet will charge the account a monthly administrative fee amounting to 10 % of the funds for as long as you have funds on the account or until you access your account by “logging in” again. Such requirement for log-in and entry is not and does not constitute any requirement whatsoever for you to play any game, deposit funds or participate in any activity at circlebet other than logging in.
25. A client unsatisfied with how circlebet handles a complaint made by the client, is requested to send the complaint to the Lotteries and Gaming Authority in Malta by using this e-mail address: complaints@lga.org.mt>”
26. Any dispute that cannot be settled between circlebet and the client shall be settled in Malta according to Maltese law.
PRIVACY POLICY
1. By providing your Personal Information and registering with us or logging on with us when you enter our website, you explicitly consent to circlebet processing and disclosing your Personal Information for the purposes, and otherwise in the manner, set out on this page, or as otherwise provided in accordance with the Terms and Conditions.

8. circlebet reserves the right to share personal information to our exclusive marketing partner that is also bound by this privacy policy.
9. circlebet may also disclose your personal information in certain circumstances. Sometimes we are required or authorised by the law to disclose your personal information. For example circlebet discloses personal data when ordered to do so by order of the Governing Authorities and/or under provision in the Governing Law. Furthermore, circlebet reserves the right to disclose personal data to relevant recipients when circlebet has reasonable grounds to suspect irregularities that involve a circlebet Account.
10. We may also disclose your personal information where you have consented to us doing so. Your consent to the disclosure of your personal information may be given explicitly such as in writing or verbally or may be implied from your conduct such as when you discuss details of the relationship you have with us publicly with the media.
11. Additionally, your Personal Information may be disclosed to any regulatory or sporting body in connection with policing the integrity or enforcing the rules of a sport or game and/or prevention and detection of crime and with whom circlebet has agreements from time to time for the sharing of such data and where circlebet considers that there are reasonable grounds to suspect that you may be involved in a breach of such rules or the law, have knowledge of a breach of such rules or the law or otherwise pose a threat to the integrity of the relevant sport or game. Those bodies may then use your Personal Information to investigate and act on any such breaches in accordance with their procedures.
BONUS RULES
1. Complimentary or bonus amounts (EURO or VIP-points) credited by circlebet to a client for promotional purposes may only be used to play in the games according to the rules in the bonus offer.
2. Withdrawals from accounts that have taken part of a bonus are accepted only after complying with the rules set out in the bonus offer.
3. Only one account per IP-address and household is entitled to take part of the same bonus offer (signup bonus or deposit bonus).
4. Referral bonuses are only given for real players referred to the site.
5. circlebet reserves the right to cancel or withdraw a promotional offer as well as changing the criteria for taking part of the offer at any time regardless of any information given in conjunction with the offer. circlebet reserves the right to close any account that is suspected to be involved in bonus abuse and confiscate funds in such accounts.
6. To be eligible for any of the bonuses offered by circlebet all personal information must be updated and accurate in the player account. If circlebet finds out that incorrect information is registered in the account circlebet reserves the right to cancel any bonuses that have been paid out to the account.
POKER RULES
1. All poker games are played in EURO (EUR).
2. circlebet is part of the Entraction Network (former 24hNetwork) meaning, that the same player may have accounts with other operators within the network. If a Poker Client Software from another partner in the network is open circlebet ’s Poker Client Software cannot be started and vice versa.
3. It is strictly forbidden for a player to play at the same table with different nicknames used at different sites within the network. It is also forbidden to join the same tournament with different nicknames.
4. Players from the same household are not allowed to play at the same real money table or 1-table tournamnets.
5. circlebet does not allow any automated programs that enable artificial intelligence to play at the site. Only physical persons are allowed to open accounts and play at the site, and the use of such “bot” software programs is strictly forbidden.
6. Poker is an individual game where players play for their own interest. Any kind of cooperation or partnership between players is strictly forbidden.
7. circlebet reserve the right at our own discretion to cancel, reverse or adjust any transactions and/or forfeit funds due to any collusion and/or criminal acts.
8. Chipdumping (when a player deliberately loses hands to transfer money to a partner player) is considered illegal and circlebet reserves the right to freeze accounts involved in chipdumping and also to confiscate funds held in such accounts.
9. It is strictly forbidden to give away any information about your hand before a pot is finished by communicating with other players.
10. circlebet offer the players a chat feature. All chat must be in English, not comment on pots in progress, not contain disrespectful comments about other players nor make any comments or use expressions that may offend other players.
11. A player shall not register or utilise a nickname that may be deemed to be similar to a trademark, company name or be deemed offensive or abusive to other players.

13. Managements decision is final.
SPORTSBETTING RULES
ACCEPTANCE AND SETTLEMENT OF BETS
1. All betting is done in EURO (EUR). The minimum bet is EUR 0,10 and the maximum bet on one slip varies from time to time and is displayed in connection to the betting object.
2. circlebet accepts singles on most betting objects. Some objects require minimum doubles or trebles though. Most objects can be part of multiple bets (accumulators).
3. The highest number of betting objects accepted in a combination is ten (tenfolds).
4. A bet is valid only after circlebet has accepted it. Residents of USA are not allowed to place bets with us.
5. Multiple bets are not accepted where the outcome of one part of the bet contributes to the outcome of another. If such a bet is accepted by mistake, the bet is considered void.
6. circlebet odds are fixed at the time the bet is placed. The odds cannot be revised once the bet has been accepted.
7. The maximum net winning for bets placed the same day is EUR 25 000, regardless if the system has accepted the bets.
8. Sufficient funds must be available in the sportsbetting account before a bet can be made.
9. Once a bet has been confirmed by circlebet , it cannot be changed or cancelled by the client.
10. In the following circumstances bets will be void, and all stakes returned to the player's account. Should a void betting object be a part of a multiple bet, all the outcomes will be settled at the odds 1.00 and the rest of the multiple bet will be valid:
a. If a bet has been placed after the start of an event, even if the bet has been accepted.
b. If an obvious error due to misprint, misunderstanding or server failure has been made in the prices or conditions.
c. Where circlebet is convinced that a syndicate has placed bets, in order to exceed the win limits.
d. Where circlebet is convinced that match rigging or other inappropriate actions has affected the result or betting of an outcome.
e. If the betting object is postponed, cancelled or discontinued and not completed within the time limit for that sport (see specific sport rules).
11. circlebet reserves the right to accept or refuse, all or part of, any bet requested. It is not allowed to place bets on behalf of others. We reserve the right to void bets placed by robots at our own discretion.
12. Dead heat - In a "dead heat" the stake money on a selection is divided by the number of runners involved in the dead heat. The full odds are then paid to the divided stake, with the remainder of the stake money being lost.
13. First goal scorer. The winner is deemed to be the player who scores the first goal of the match. If the first goal is an own goal, all bets played on the first goal scorer are deemed losing. If there is a dispute over who is the first goal scorer, the bets will be settled according to the organising authority's match report. Bets on players who have not participated in the game before a goal is scored are void.
14. Correct Score. Bets on Correct Score are determined by the score at the end of normal time.
15. Over/Under totals. Goals or points scored on extra time and penalty shoot-outs do not count unless otherwise stated. If odds are offered for a group of matches, all games must be completed or bets will be void.
DISPUTES
16. All customer claims must be brought to circlebet 's attention, no later than thirty-one (31) days after that day, the wager in question was placed or settled. No claims will be honoured after this period.
17. For any matters not covered by these rules or by the contents of the Internet site, circlebet reserves the right to decide on an individual basis on the basis of equity.
18. circlebet takes no responsibility for damages caused, directly or indirectly, by our web site or its contents. This includes transaction errors, delays or inaccessibility to reach the web site or other damages caused by malfunction of our system.
FOOTBALL (SOCCER)
19. The official result after normal full time (90 minutes + injury time) is used to settle bets.
20. Extra time, golden goals or penalty shoot-outs do not count unless specifically stated.
21. Games must be played at least 85 minutes to have action. If not, all bets will be void, except those which already been decided (e.g. first goal scorer, first corner, etc).
22. If a game is postponed, it must start within 24 hours after the original starting time or bets will be void.
ICE HOCKEY
23. The official result after normal full time (60 minutes) is used to settle bets.
24. Extra time or sudden death does not affect the result unless specifically stated.
25. For NHL matches without a draw option (with or without a handicap) bets are always settled including extra time.
26. Games must be played at least 55 minutes to have action. If not, all bets will be void, except those which already have been decided (e.g. first goal scorer, etc).
27. If a game is postponed, it must start within 24 hours after the original starting time or bets will be void.
AMERICAN FOOTBALL
28. Bets will be determined on the official final score, including extra time.
29. Games must be played at least 55 minutes to have action. If not, all bets will be void.
30. The first half must be completed, for first-half bets to stand.
31. For second half betting, only the second half result, including overtime will count. No more than 5 minutes can remain of the match, for bets to stand.
32. If the final result is a draw, including the handicap, bets are void, unless an odds was given for the draw.
33. If a game is postponed, it must start within 24 hours after the original starting time or bets will be void.
BASKETBALL
34. Bets will be determined on the official final score, including extra time, unless otherwise stated.
35. If the final result is a draw, including the handicap, bets are void, unless odds were given for the draw.
36. Games must have played at least 43 minutes to have action. If not, all bets will be void.
37. If a game is postponed, it must start within 24 hours after the original starting time or bets will be void.
BANDY
38. The official result after normal full time (90 minutes + injury time) is used to settle bets.
39. Extra time, golden goals or penalty shoot-outs do not count unless specifically stated.
40. Games must be played at least 85 minutes to have action. If not, all bets will be void, except those which already have been decided (e.g. first goal scorer, first corner, etc).
41. If a game is postponed, it must start within 24 hours after the original starting time or bets will be void.
HANDBALL
42. The official result after normal full time (60 minutes) is used to settle bets.
43. Extra time or sudden death does not count unless specifically stated.
44. Games must be played at least 55 minutes to have action. If not, all bets will be void, except those which already have been decided (e.g. first goal scorer, etc).
45. If a game is postponed, it must start within 24 hours after the original starting time or bets will be void.
FLOORBALL
46. The official result after normal full time (60 minutes) is used to settle bets.
47. Extra time or sudden death does not count unless specifically stated.
48. Games must be played at least 55 minutes to have action. If not, all bets will be void, except those which already have been decided (e.g. first goal scorer, etc).
49. If a game is postponed, it must start within 24 hours after the original starting time or bets will be void.
TENNIS
50. Outright bets (win and place) are considered all in, meaning that a bet stands even if a player doesn't compete.
51. For a tennis match to have action the whole match must be completed, meaning that a player must have won a match point. If not all bets are void.
52. If a match is postponed or delayed, all bets will stand as long as the match is played within the tournament.
GOLF
53. All outright and tournament match bets have action once 36 holes have been completed.
54. For outright betting, play-offs will determine the tournament winner, if needed. For all other places, dead heat rules will apply.
55. Wagers placed on players not starting will be refunded.
56. If there is no further play after a bet has been placed, it will be void.
57. All match bets and 2 & 3 ball bets have action once all players involved have teed off.
58. Winner will be the player completing the most holes. If both players complete the same number of holes, the player scoring the lowest total will be considered the winner.
59. Should both players finish level in a match bet or a 2 ball, the bet will be void and stakes will be returned, unless a price was quoted for the tied result.
60. In the event of winners tying in 3 ball or group betting, dead heat rules will apply.
61. If all players in the match-up fail to complete the round, or are disqualified, all bets are void and stakes refunded.
62. Any group or tournament bets with quotes for 6 or fewer players are void if ANY of the named players does not start his round/tournament.
63. If more than 6 players are quoted, stakes will be refunded on non-runners, and betting on other players will stand. If the total number of players remaining is less than 6, all bets will be void.
64. Dead heat rules will apply on group betting.
ATHLETICS
65. Betting on athletics is considered as all in, meaning that all bets stand even if the athlete does not compete (only outrights, in group betting and h2h the athletes needs to start).
66. The medal ceremony will determine the settlement of the bets, regardless of any future changes (like disqualification).
67. Should there be no medal ceremony; the official I.A.A.F. result will determine the outcome of the betting.
BOXING
68. If a fight is postponed or rescheduled all bets are void.
69. If a price is offered for the draw, bets on either fighter will be lost if the fight ends with a draw. If no price is offered for the draw, bets on either boxer will be void in case of a draw.
70. The judges decision, including points, KO, TKO or disqualification will decide bets on either boxer to win.
71. If a boxer fails to answer the bell for the next round, the fight will be deemed to have finished in the previous round.
72. If the scheduled number of rounds for any reason will be changed, all bets for boxers to win on points and all round by round bets will be void.
CYCLING
73. Outright betting (win and place) is considered all in, meaning that all bets stand even if the runner does not compete.
74. Head to Head betting and Group betting with one or more non-runners are void.
75. If both riders in a Head to Head match up or all riders in a Group fail to complete the stage/race, or are disqualified before 24.00 CET on the day of the race, all bets are void.
76. During Tour de France and Tour of Spain stage bets (or last stage for betting made on the entire competition) are settled in accordance with the results presented at 24.00 CET on the day of the race at the official website for the competition. All future changes will be left without any consideration.
MOTOR SPORT - FORMULA ONE/CART/INDYCAR
77. Betting on the Formula One/Cart/Indycar championship or specific Grand Prix races is considered as all in, meaning that all bets stand even if the racer does not compete.
78. The podium ceremony will determine the settlement of the bets, in specific Grand Prix races, regardless of any future changes (like disqualification).
79. Betting on the Formula One/Cart/Indycar championship is decided, based on the amount of points received over the season, immediately after the podium ceremony of the last race.
80. All future changes will be left without any consideration.
81. In match-ups (driver vs. driver) or group bets, all drivers must start, for bets to have action.
82. If, in a match race, both drivers fail to finish, the one with most completed laps will be determined as winner. If they complete the same number of laps, bets are void.
83. The signal for the warm-up lap is considered as the start of the race.
MOTOR SPORT - NASCAR
84. Betting on the Nascar championship or specific races is considered as all in, meaning that all bets stand even if the racer does not compete.
85. The podium ceremony will determine the settlement of the bets, in specific races, regardless of any future changes (like disqualification).
86. Betting on the Nascar championship is decided, based on the amount of points received over the season, immediately after the podium ceremony of the last race.
87. All future changes will be left without any consideration.
88. In match-ups (driver vs. driver) or group bets, all drivers must start, for bets to have action.
89. If, in a match race, both drivers fail to finish, the one with most completed laps will be determined as winner. If they complete the same number of laps, bets are void.
90. In case the starting driver is replaced during the race with another driver from the same team, the position the new driver finishes in will be awarded to the original driver.
91. The signal for the warm-up lap is considered as the start of the race.
TROTTING
92. Ante post bets for a specific race are considered all in if fixed odds are offered in advance, meaning that all bets stand, even if the horse doesn't compete.
93. When betting on match-ups, the horse that achieves the best result in a match is the winner. Both horses must start for bets to have action.
94. An unplaced horse that has completed the race is deemed as the winner over a horse disqualified, outdistanced or failed to complete.
95. If both horses in a match are disqualified, outdistanced or do not get any time recorded, bets will be void and stakes refunded on both horses.
96. If both horses finish in the same position, bets will be void and stakes will be refunded on both horses.
97. The official results will be used to settle the bets.
TROTTING – BETTING ON SELECTED SCANDINAVIAN TROTTING RACES
98. For this type of betting the fixed odds are announced after the race.
99. The fixed odds offered by circlebet will never be lower than on the racetrack.
100. The maximum net win for such bets are EUR 1 000. The win and Top 3 are counted separately.
101. No paybacks are made for losing bets where the possible win amount would have been higher than the limit.
102. For this type of betting stakes are refunded on no runners.
103. The bet type is called “Place – Top 3” but if only 2 spots are paid at the track circlebet will only pay 2 spots.
ALPINE SPORTS
104. Bets on Outright is considered as all in, meaning that all bets stand, even if the skier doesn't compete.
105. In head-to-head matches both participants must start (leave the start gate). Otherwise the bets are considered void and the odds set to 1,00.
106. If both participants are disqualified in the 1st leg or, if both qualify for the 2nd leg but are disqualified in this leg, bets are considered void and the odds set to 1,00.
107. If one of the participants misses the qualification for 2nd leg his opponent is deemed the winner even if the opponent is disqualified in the 2nd leg.
108. If both participants fail to qualify for the 2nd leg the quickest time from the 1st leg wins.
109. The official result will be used to settle the bets.
BASEBALL (MLB)
110. All bets on MLB include extra innings. Bets stand regardless of starting pitcher (no named pitcher).
111. Games are official after 5 innings of play, if the home team is winning. The game is official after 4 1/2 innings of play, if the away team is winning. If a game goes past 5 innings and is later called off, suspended or postponed, the winner is determined by the score after the last full inning of play.
TABLE TENNIS
112. Outright bets (win and place) are considered all in, meaning that a bet stands even if a player doesn't compete.
113. For a table tennis match to have action the whole match must be completed, meaning that a player must have won a match point. If not, all bets are void.
114. If a match is postponed or delayed, all bets will stand as long as the match is played within the tournament.
NET ENTERTAINMENT CASINO RULES
1. The Casino software is provided by Net Entertainment AB, Sweden that is listed on the Stockholm stock exchange.

4.10. “Website Provider” means the person/s responsible for the operation of the Website.

16. Subject to these terms and conditions and the terms and conditions of use of the Website, when you open an account through the Website you become entitled to play the Games.
17. When you log into your account and choose to play a Game you will navigate away from the Website Provider’s game server to WagerWorks’ game server in Guernsey.
18. To play a Game you must have sufficient funds credited to your account. You can only place a wager from your account.
19. When you choose to play a Game an “auto-pull” of funds from your account will take place which means that the entire available balance on your account is transferred to WagerWorks. At the end of your gaming session your account with the Website Provider will be updated with any remaining funds.
20. Wagers are only valid if accepted by WagerWorks’ server. Until acceptance of the wager by WagerWorks’ server all information displayed relating to a Game constitutes an invitation to play only.

25. When you update a loss or stake limit whilst playing a Game that loss or stake limit will not be updated until you close the current gaming session and start a new one.

31. In the event that you win MegaJackpots®:
31.1. the Wesbite Provider will provide WagerWorks with the following information: your name, age, town, county, state and/or country of residence together with the fact that you have won MegaJackpots®; and
31.2. you will be required to supply proof of your identity, residence and age to WagerWorks.
32. When you play a MegaJackpots® Game you authorise WagerWorks, in the event that you win MegaJackpots®, to publicise your name, town, county, state and/or country of residence together with the fact that you have won MegaJackpots®.
33. Verification of a win in a MegaJackpots® Game can take up to 72 business hours. If you win MegaJackpots® you only become entitled to the prize money once your win has been verified. Where a win is not verified to Wagerworks’ satisfaction that win can be annulled by WagerWorks.
34. If you win MegaJackpots® you will be informed in writing when your win has been verified.
35. Except in case of a MegaJackpots® win, the prize money in any Game will, as a rule and provided all these terms and conditions and all the Website’s terms and conditions have been observed, be paid to you by the Website Provider.
36. In case of a MegaJackpots® win WagerWorks will, provided all these terms and conditions and all the Website’s terms and conditions have been observed, pay or procure the payment of the prize money to you.
37. If you win MegaJackpots® the prize money shall be paid to you in 20 equal annual instalments. For the avoidance of doubt, no interest will accrue in your favour on any unpaid balance. In lieu of the annual payments, a MegaJackpots® winner will be offered the option of selecting a reduced lump sum amount based on the present value of the future payments.
38. Either WagerWorks or the Website Operator may discontinue the provision of a Game at any time.
39. Following a MegaJackpots® win WagerWorks shall be entitled to establish the re-seed amount at its absolute discretion.
40. When you play a Game you agree to forfeit your wager and any winnings if you leave the Game “in progress” for a period of 90 days or more. For example, in a game of Black Jack, if the cards are dealt but you do not make the decision to “hit” or “stand” within 90 days from the day on which you have made the wager you will loose both that wager and any winnings that you may have otherwise been entitled to. In order to avoid this situation occurring you should follow the procedures set out in the Game Rules.
41. Should either WagerWorks or the Website Provider decide to discontinue the provision of a MegaJackpots® Game, or should a MegaJackpots® Game become unavailable due to Force Majeure, any prize money related to that Game’s MegaJackpots® shall be appropriated by WagerWorks.
42. WagerWorks may increase or decrease a MegaJackpots® prize money at any time at its absolute discretion.
43. If two players simultaneously win MegaJackpots®, WagerWorks’ systems server shall determine who of the two is to receive the prize money. The other person shall be entitled to the MegaJackpots® re-seed amount.
44. The Games are provided “as is”. WagerWorks makes no warranty or representation, express or implied, in respect of the Games.
45. You play the Games entirely at your own risk.
46. You shall not hold WagerWorks, its owners, employees, affiliates, suppliers or other companies or people linked to WagerWorks responsible for any costs or damages (including without limitation, any direct, indirect, punitive or consequential loss or damages or any loss of income profits, goodwill, data or contracts and whether in tort, contract or otherwise) that you incur as a result of your:
46.1. use of the Website or the Games;
46.2. use of any material from the Website;
46.3. use of any WagerWorks’ servers;
46.4. use of any of WagerWorks’ software; or
46.5. participation in any Game or the winning of any prize;
but nothing in these terms and conditions shall exclude or limit liability for any matter, liability for which cannot be excluded under the applicable law.

56.2. violation by you of any law or the rights of any third party;
56.3. use by you of the Games or use by any other person accessing the Games using your user identification, whether or not with your authorisation; or
56.4. acceptance of any winnings.
57. Where there is a conflict between any provision of the Website’s terms and conditions of use and these terms and conditions, these terms and conditions shall prevail.

59. If, for any reason, a court of competent jurisdiction finds any provision of these terms and conditions, or portion thereof, unenforceable, invalid, or unlawful, then the remainder of these terms and conditions shall continue in full force and effect and will be read to give maximum effect to the intention of the parties as reflected by its plain language.
60. These terms and conditions constitute the entire understanding between the parties in respect of the use of the Games and supersede all prior or contemporaneous understandings regarding such subject matter.
61. These terms and conditions are governed by the laws of Alderney and its courts shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions.
